How long does a divorce take?

An uncontested divorce can often be finalised within a few weeks to a few months, depending on the Court's availability. A contested divorce may take significantly longer, particularly if disputes regarding children, maintenance or assets need to be resolved.

What is the difference between a contested and uncontested divorce?

An uncontested divorce is where both spouses agree on all aspects of the divorce, including the division of assets, maintenance and arrangements for children. A contested divorce arises when one or more of these issues cannot be agreed upon and require negotiation or a Court decision.

How are assets divided in a divorce?

The division of assets depends on your matrimonial property regime. Whether you were married in community of property, out of community of property with accrual, or out of community of property without accrual will determine how assets are divided.

What happens if we have children?

The Court's primary concern is always the best interests of the child. Parenting arrangements, care, contact and maintenance can either be agreed between the parties or determined by the Court if agreement cannot be reached.

Can we get divorced if my spouse doesn't agree?

Yes. A spouse cannot prevent a divorce simply by refusing to consent. If the marriage has irretrievably broken down, the Court may grant a divorce, although disagreements regarding finances or children may need to be resolved through litigation.

Will I have to go to Court?

Not always. Most uncontested divorces require only a brief Court appearance by one party. Contested divorces may involve mediation, negotiations and, if necessary, Court proceedings.

Can we settle everything without going to trial?

How is maintenance determined?

Maintenance depends on factors such as each party's income, financial needs, standard of living during the marriage and, where applicable, the needs of any dependent children. Every matter is assessed on its own facts.

What if my spouse is hiding assets?
